BeeSnare End User License Agreement (EULA)
1. Agreement
This EULA is a legal agreement between you and BeeSnare for the BeeSnare desktop software, including its executables, files, and updates (the "Software"). By installing or using the Software, you agree to this EULA, our Terms of Service, and our Privacy Policy. If you do not agree, do not install or use the Software.
2. License grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or are authorized to control, for your own use, subject to this EULA. Paid features are enabled by a license key issued through Polar, our payment provider; this license permits installation on one (1) device per license.
3. Restrictions
You may not:
- reverse engineer, decompile, or disassemble the Software, except to the extent applicable law or an included open-source license expressly permits;
- copy, redistribute, resell, rent, lease, sublicense, or otherwise transfer the Software or your license key;
- remove or alter any proprietary notices in the Software;
- use the Software to access, deceive, surveil, or harm systems or people you do not own or control, or to plant decoys on devices you are not authorized to use;
- circumvent the license validation or use paid features without a valid subscription.
4. Ownership and intellectual property
The Software is licensed, not sold. We and our licensors retain all right, title, and interest in the Software, including all intellectual property rights. "BeeSnare" and related marks are our trademarks. This EULA grants you no rights to our names, logos, or marks.
5. Open-source and third-party components
The Software includes third-party and open-source components licensed under their own terms. Those terms are listed in the THIRD-PARTY-NOTICES file distributed with the Software. Nothing in this EULA limits your rights under, or overrides, those component licenses. Where an open-source license conflicts with this EULA for that component, the open-source license governs that component.
6. Your device, vault, and recovery
The Software stores its data in an encrypted vault on your device. As described in the Terms of Service:
- If you choose no master password, the vault unlocks via your Windows user account. If you lose that account (for example, an operating-system reinstall without a backup), the vault cannot be recovered, including by us.
- If you set a master password, you can reset it locally from the lock screen without losing data. This happens entirely on your device, with no email reset and no server.
- The in-app vault wipe permanently and irreversibly deletes all vault data on your device.
You are responsible for the security of your device, your Windows account, and any master password you set.
7. Updates
The Software checks for updates and may download and install them. An update check transmits only limited technical data, such as your current version and platform, and sends no vault or decoy data. Updates are cryptographically signed, and the Software verifies the signature before installing, so that only authentic BeeSnare updates are applied. Unless accompanied by separate terms, updates are governed by this EULA. Some updates may be required for the Software to keep functioning, and updates may install automatically.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEESNARE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BEESNARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT IT WILL DETECT ANY PARTICULAR THREAT OR INTRUSION; THAT DECOYS WILL BE ACCESSED BY AN ATTACKER; OR THAT ALERTS WILL BE TIMELY OR DELIVERED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BEESNARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, ACCOUNTS, FUNDS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SOFTWARE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY. BEESNARE'S TOTAL CUMULATIVE LIABILITY IS LIMITED AS SET OUT IN THE TERMS OF SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Term and termination
This EULA applies until terminated. It terminates automatically if you breach it. On termination, you must stop using and uninstall the Software. Your on-device vault remains yours and under your control until you delete or wipe it. Sections on ownership, disclaimers, liability, and governing law survive termination.
11. Export and compliance
You may not use or export the Software except in compliance with applicable export-control and sanctions laws.
12. Governing law
This EULA is governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules.
13. General
If any provision is found unenforceable, the rest remains in effect. This EULA, with the Terms of Service and Privacy Policy, is the entire agreement between you and us regarding the Software.
